Terms & Conditions
Please take time to read through thoroughly and ensure you understand these terms and conditions before you begin work with our studio.

COMMENCEMENT OF PROJECT
We require 50% of all project fees up front. Please note this is not a refundable deposit. Also note further charges may apply if you cancel the project before completion.
The remaining balance is due upon completion of the project.
Projected timelines are not official until Estimate is accepted and deposit received.
EXCESS WORK
If the project is deemed by Suska Digital Design Company to be greater than specified in its quote, Suska Digital Design Company may notify the Client outlining additional charges. New design requests can be accommodated at our hourly rates of $95 per hour for design and $110 per hour for development.
LIABILITY REGARDING WORK AND MATERIALS PROVIDED
Suska Digital Design Company is not responsible for investigating copyright or trademark matters for the Client. The Client must ensure that all material used (for their print material and for their website) is legally usable.
Suska Digital Design Company is not responsible for copying and pasting text. The Client must check all text before approving designs for printing or web publishing.
Suska Digital Design Companys’ liability to the Client for loss of any kind resulting from services provided shall be limited to Suska Digital Design Companys’ fee paid by client without interest. Suska Digital Design Companys will not be liable for damages of any kind including its own negligence, excluding gross negligence.
The Client will indemnify and hold harmless Suska Digital Design Company against any and all claims and expenses, including reasonable legal fees, arising from the use of Suska Digital Design Companys’ work.
APPROVAL OF FINAL ARTWORK
The Client should carefully proofread any design material provided by Suska Digital Design Company before it is printed or uploaded to its website.
While Suska Digital Design Company takes all care to avoid errors, Suska Digital Design Company accepts no responsibility for typographical errors, spelling mistakes, or incorrect information on any project. No refunds or reprints are given after a final approved design has gone to print due to oversights by the Client’s proof reading.
COLOUR VARIATIONS
With all printing and website there may be some colour variations from what you have seen on screen, to what the final product looks like, and previous orders. This is due to the nature of CMYK printing, screen settings and printing system. There will be no reprints at our expense.
WEBSITE DESIGN CREDIT
The Client agrees to allow Suska Digital Design Company to place a small credit on printed material exhibition displays, advertisements and/or a link to Suska Digital Design Companys’ own website on the Client’s website.
The Client also agrees to allow Suska Digital Design Company to place websites and other designs, along with a link to the client’s site on Suska Digital Design Companys’ own website and other websites Suska Digital Design Company deems useful for promotional purposes.
WEBSITE DESIGN POST-COMPLETION ALTERATIONS
We offer a 14-day technical support after site launch. Support includes site maintenance instruction, content edits, and any functional bugs or glitches, and minor styling changes like color and font. Support excludes major feature requests, new transactional functionality (e.g. adding a shopping cart), layout changes, and significant branding and design (e.g. new logo, ebooks, marketing badges). Tasks will be scheduled in 1-hour segments, and upon availability. After the 14-day period, past clients have the option to purchase support in 5-hour increments to be used at any time and based on availability.
Any minor changes can be notified to Suska Digital Design Company by e-mail. Suska Digital Design Company will consider that the Client has accepted the original draft, if no notification of changes is received in writing from the Client, within 15 days from Suska Digital Design Company sending a ‘completion’ notice via email.
LITIGATION
It is agreed that the Client indemnify and hold Suska Digital Design Company harmless from and against all claims for injury or death to persons or damage to property (including cost of litigation and legal fees) caused by, arising from or incidental to the services to be performed during the performance of the work outlined.
PRINTING
When Suska Digital Design Company is asked to provide printing services, we reserve the right to choose the best printer for the project, taking the preferences of the Client into account. Suska Digital Design Company will make every effort to coordinate printing and deliveries to meet client’s deadlines; however, Suska Digital Design Company cannot be held responsible for printing or delivery delays.
If Suska Digital Design Company prepares electronic files or artwork for the Client’s printer, all aspects of the printing become the sole responsibility of the Client.
PROVIDING COPY
Suska Digital Design Company encourages the Client to provide unformatted text of their work in Word format in order to avoid the time and errors involved in retyping the text.
COPYRIGHT & INTELLECTUAL PROPERTY
Suska Digital Design Company will retain intellectual copyright of any material, including any source code and original images created for you until final payment is received. Once payment has been received in full, the intellectual copyright will be passed on to you.
ADDITIONAL EXPENSES
Additional expenses may need to be added to Suska Digital Design Company charges, including out-of-pocket expenses, courier services, shipping, postage and handling and travel costs, If these services are needed, they will be billed by Suska Digital Design Company. Quotes for these items are estimates only.
All plugins, themes, fonts and templates required for project will be purchased and billed separately unless otherwise specified in quotation.
Stock photography will be purchased and billed separately.
PRE-PAID PACKAGES
Prepaid hourly retainer packages can be used for all services offered by Suska Digital Design Co.
- These packages are subject to change.
- Time is tracked to nearest minute.
- Complicated code & development work may be charged extra.
- Prepaid Packages expire 1 Year after purchase.
- Amounts cannot be used to pay for hosting or domain registration.
- Time gone over the prepaid amount will be billed separately.
- Packages are non-refundable.
AMENDMENTS TO THESE TERMS AND CONDITIONS
All and any amendments to the terms and conditions outlined in this submission must be provided in writing by the Client and signed by an authorized representative of Suska Digital Design Company prior to the commencement of work outlined.
